Organ transplants suspended in three hospitals

Yesterday, during the Fourth National Seminar on Organ Transplant, (held October 20 – November 2 in Beijing) deputy minister of Health Huang Jiefu stated that illegal organ transplants have been performed by three hospitals located in Beijing, Tianjin and Xinjiang.

These were the first three instances of illegal transplants to be discovered since the Regulations on Organ Transplant went into force on May 1 last year.

According to figures released by the Ministry of Health, every year 1.500.000 Chinese patients need a transplant, besides those foreign patients who travel to China to obtain a faster and cheaper transplant. Yet, the number of available organs is merely 10.000.

The consequences of such an imbalance between demand and supply can be easily imagined…..

To prevent the occurrence of illegal transplants, besides the Regulations on Organ Transplant, the Ministry of Health issued a Circular about the problem of aliens requesting organ transplants (卫生部办公厅关于境外人员申请人体器官移植有关问题的通知 – full text below). Also, regulations to determine the criteria of cerebral death should be issued by the end of this year.

人体器官移植有关问题的通知

卫办医发〔2007〕110号

各省、自治区、直辖市卫生厅局,新疆生产建设兵团卫生局,部直属各单位:

  为了认真贯彻《人体器官移植条例》,切实加强我国人体器官移植管理,根据世界卫生组织人体器官移植指导原则,参照其他国家和地区通行做法,现就境外人员申请实施人体器官移植有关事宜通知如下:

  一、医疗机构及其医务人员不得为以旅游名义到我国的外国公民实施人体器官移植。

  医疗机构及其医务人员不得以旅游名义跨国境为外国居民实施人体器官移植。

  二、外国居民申请到我国实施人体器官移植的,医疗机构必须向所在省级卫生行政部门报告,经省级卫生行政部门审核并报我部后,根据回复意见实施。
  三、我国人体器官移植优先满足中国公民(包括香港、澳门、台湾永久性居民)需要。

  四、医疗机构在为香港、澳门、台湾永久性居民实施人体器官移植前,必须向所在省级卫生行政部门报告。省级卫生行政部门要及时向我部报告。

  五、除《医疗广告管理办法》(国家工商行政管理总局、卫生部令第26号)规定的内容外,医疗机构不得利用任何方式发布人体器官移植医疗广告。
  六、省级卫生行政部门对医疗机构开展人体器官移植情况,要纳入技术临床应用能力定期评估的重要内容并严格考核。对医疗机构及其医务人员违反规定实施人体器官移植的,要依法严肃处理,并撤销医疗机构相应专业的人体器官移植诊疗科目登记。
